At Lexel, our advocates have the expertise to effectively represent in your civil cases. We have been instrumental in handling a wide variety of disputes and with a good measure of success.

A cause of action in a civil case commences when a right of a person or a business is said to have been harmed by the actions of another person or business.

Civil cases typically involve disputes between people or institutions such as businesses, usually over money. The person harmed can request the court of law for relief by filing a civil suit to award damages or compensation for the harm suffered, or can also request the court to pass an injunctive order preventing the other part from doing something, or the person harmed may also seek a declaratory relief. The court which is seized of this dispute and in order to resolve it will determine the facts of the case and will apply the appropriate law to those facts. Based on this application of the law to the facts, the court will decide what legal consequences ultimately flow from the disputing parties’ actions.

Some illustrative civil disputes that the Firm specializes in are:

Contractual disputes

A contract is a legal document between two or more parties that clearly spells out just what is expected and required of each party in a particular transaction. A contractual dispute occurs when parties have conflicting interpretations over the terms of a contract and one party seeks specific performance or damages or both from the other party. Whether it is a simple breach of a commercial contract or whether it involves disputes arising from multi-party contracts, we specialise in rendering spot-on legal advice to our clients by reviewing the contract, conducting fact finding, by reviewing other documentation in connection with the contract, etc. In all cases, we are in constant communication with our client and put on the table the possible options that exist in law for resolving such contractual disputes, whether through court litigation, or arbitration, or mediation and reconciliation.

Employment and Service disputes

Labour relations can give rise to various disputes, for example regarding pay and working hours or because of discrimination or an appeal against dismissal. There are a variety of reasons for this. The way the dispute is resolved will depend on the type of labour relation (governed by public law or private law), and on the number of persons concerned (collective or individual labour disputes). The firm has substantial experience in litigating all types of employment disputes on behalf of both employers and employees. While our aim is to help you stay out of the court, however, if the occasion otherwise demand, our lawyers are perfectly placed to assist you if the dispute ends up in court.
