Debt Recovery & Insolvency

LEXEL offers legal representation as well as legal advisory to clients (creditors and debtors) on all matters relating to distressed situations. On the litigation side, the firm’s lawyers provide representation before Debt Recovery Tribunals and other judicial fora for representing banks, financial institutions or borrowers in recovery, compromise or settlement negotiations and conciliation proceedings both on behalf of Banks and Financial Institutions and on behalf of private clients.

We deal in all matters connected with Debt Recovery Tribunals and Securitization Act including drafting of DRT replies, counter-claims, counter-suits, suits, writ petitions, etc. We provide legal advice on preventive legal measures for avoidance of any factors that may cause the company to become insolvent. We also assist our clients by preparing relevant documents for financial restructuring through insolvency processes.

We also render strategic advice to our clients (individuals, employees and companies) on various remedies on recovery of their defaulted debt as being the creditors including filing and dealing with recovery proceedings before NCLT (National Company Law Tribunal) under the Insolvency and Bankruptcy Code. We also defend companies facing action and the risk of commencement of corporate insolvency process before NCLT.
