Bails in Murder & Attempt to Murder Cases

Bails in Murder (Section 302 of IPC) and Attempt to Murder (Section 307 of IPC) are mostly complex cases since primarily the types  of offences involved therein are of the nature of non-bailable offences which are most commonly exploited by the complainant in order to settle old score with the accused and in this settling of personal vendetta, they try to rope in maximum number of persons as ‘accused’ in the alleged occurrence. As a result, the original incident is given a false narrative and a fabricated version wrongly showing the participation of a large number of accused. The police investigation is also compromised by and large in support of the complainant.

 

As the punishment in India in Murder trials is very severe often resulting in punishment of sentence to life, we at Lexel carefully go through the statements of complainant and associated witnesses in order to sift between truth and false with the help of forensic and experts report relying on various technicalities of law to draw a presumption of innocence in favour of the accused resulting in his bail and subsequent acquittal.
